U.S. and China Trade Tariffs – 2019

China opened its exclusion request process on Sept. 2, 2019 for U.S. goods on China’s Section 301 retaliation Lists 3A through 3D to potentially remove retaliatory duties ranging from five percent to 25 percent tariffs on nearly all of PMMI products.  Exclusion requests will be accepted through Oct. 18, 2019.

PMMI members that export US goods to China may want to work with their importers in China to potentially submit an exclusion request.  The application can be found on China’s Tariff Policy Research Center website (https://gszx.mof.gov.cn). The instructions in Chinese can be found here. Earlier this year, when the exclusion process was opened for products on List 1, the US Foreign Agricultural Service in China provided an English translation of instructions for submitting an exclusion request which may be helpful for your US exporting members to understand the process and information requested. 

While an exclusion is not guaranteed, if an exclusion request is accepted, the Chinese government will not collect additional retaliatory tariffs against US Section 301 measures for one year of approval, and will refund any additional tariffs already collected on such products.
